Tame Impala are allegedly facing a lawsuit from Samm Culley, the drummer from 70s funk band Skull Snaps over the use of an uncleared drum sample. The Tame Impala track in question is “Eventually” from the recently released album Currents. Culley is claiming that his drum break from the beginning of “It’s A New Day” have been bitten by Tame Impala’s Kevin Parker and incorporated into “Eventually”.
Parker posted the email he received from Culley on Instagram with a statement that looked to debunk the allegation: “WOW unexpected compliment! The creator of the famous Skulls Snaps drum sample thinks my drums IS his actual sample and wants to sue me for not clearing it! Haha!! Sam Culley you have three days to fire your musicologist. Anyone think this could be a hoax though?“.
However, the email is not a hoax according to Pitchfork. The “It’s A New Day” break is one of the most sampled breaks in music history and has been one of the weapons of choice in many Hip Hop producers arsenals. Listen to the break and Tame Impala’s “Eventually” below.
